Attorney General Merrick Garland designated Delaware U.S. Attorney David Weiss as “special counsel” in the ongoing investigation into the activities of Hunter Biden. This decision allows Weiss to lead an “ongoing” criminal probe within the structural framework of the Department of Justice (DOJ). This step is viewed by many as a ploy to deflect congressional scrutiny and ensure the Biden family stays shielded.
Last month, a promising plea deal for Hunter Biden hit a roadblock. The president’s son had agreed to plead guilty to two misdemeanor tax crimes and a single felony firearm charge, only to see the deal overturned after a federal judge clarified that arrangement included questionable grants of immunity from possible future charges. Whistleblowers from the IRS also threw a wrench into the proceedings, revealing alleged DOJ interference and an incomplete pursuit of potential charges against Hunter Biden.

Russell Dye, a spokesperson for House Republican Judiciary Chairman Jim Jordan (R-OH), openly questioned the motivations behind Weiss’s promotion. “Weiss has already signed off on a sweetheart plea deal that was so awful and unfair that a federal judge rejected it,” Dye noted. “We will continue to pursue facts brought to light by brave whistleblowers as well as Weiss’s inconsistent statements to Congress.”
Indeed, the history between Weiss and the Bidens has left many suspicious. Weiss had been in charge of the first Hunter case, which seemingly stagnated until after the 2020 election, allowing the statute of limitations for certain charges to lapse. The prior plea deal offered to Hunter, criticized for its leniency, further stokes these concerns. As a New York Post article eloquently put it, Garland’s decision to keep Weiss at the helm reveals an “utter contempt for the rule of law that Team Biden has shown from the start on this.”
Concerns deepen when considering the role and powers of a special counsel. Ideally, a special counsel should come from outside the US government to maintain a semblance of impartiality. Weiss, however, is an employee directly under Garland, the Attorney General chosen by President Joe Biden.
Despite Garland’s assurances of the investigation’s independence, pressing issues remain to be addressed. Among them:
- The details of Hunter’s discussions with his father’s foreign business partners,
- The nature of Joe Biden’s alleged involvement in a bribery scheme with Hunter’s Ukrainian associates, and
- The specifics of Hunter’s income and financial agreements which might have indirectly benefited President Biden.
All these questions paint a picture of an intricate web of connections and transactions that could implicate the Biden family in improprieties. Given this backdrop, the decision to keep “Slow-as-Molasses Weiss” in charge of the investigation could be seen as a tactic to drag the probe well beyond the 2024 elections.
