Border Czar Tom Homan has contacted the Department of Justice to determine whether Rep. Alexandria Ocasio-Cortez (D-NY) violated federal law by advising illegal immigrants on how to handle encounters with Immigration and Customs Enforcement (ICE). The move comes after she hosted an online event that provided specific guidance on dealing with ICE agents.

Homan, who previously served as the acting director of ICE, said he reached out to the Deputy U.S. Attorney General for clarification on whether her actions could be considered obstruction of law enforcement. He stated that impeding federal immigration operations is a serious matter and suggested that Ocasio-Cortez’s involvement may warrant legal scrutiny.
Tom Homan has referred AOC to the DOJ for potential prosecution.

The controversial webinar, “Know Your Rights With ICE,” was broadcast on Ocasio-Cortez’s Facebook page. The session advised illegal immigrants on how to refuse ICE searches, avoid answering questions, and take steps to prevent deportation. The event specifically targeted those living in her congressional district, which includes parts of Queens and the Bronx.

In response, Ocasio-Cortez defended her actions, claiming that ICE agents routinely enter homes without warrants and mislead individuals about their rights. She insisted that her event was focused on educating individuals about existing legal protections and ensuring immigration enforcement is carried out within legal boundaries.
Good. They are so quick to put people
In jail on trumped up charges. But this is not ok what they are doing. I’d be in jail if I interfered with an investigation. They should be held to the same standard— Joseph Lanier (@JosephLani13279) February 14, 2025
Legal analysts note that while providing general legal education is not illegal, actively instructing individuals on how to evade law enforcement could lead to further review. The DOJ has yet to confirm whether it will open an investigation into Ocasio-Cortez’s webinar.
The Trump administration has made it clear that interference with federal immigration enforcement will not be tolerated. Whether the DOJ determines that Ocasio-Cortez’s involvement crossed a legal threshold remains an open question.
