Fresh off a decisive victory in the Iowa caucuses, former President Donald Trump shifted his attention once again to one of the multiple court cases against him.
His legal team filed a motion on Tuesday as part of the federal charges of being prosecuted by special counsel Jack Smith. Specifically, the filing outlines alleged political bias exhibited by intelligence officials and others — including Smith — involved in the search of Trump’s Mar-a-Lago estate in Florida in 2022 and the resulting charges of improper handling of classified material.
The motion seeks the release of relevant material in the case, building on Trump’s prior assertions that this and other cases against him amount to election interference by President Joe Biden and his political allies.
“The Special Counsel’s Office has disregarded basic discovery obligations and [Justice Department[ policies in an effort to support the Biden Administration’s egregious efforts to weaponize the criminal justice system in pursuit of an objective that President Biden cannot achieve on the campaign trail: slowing down President Trump’s leading campaign in the 2024 presidential election,” the attorneys wrote.
Citing documents the legal team has received via a Freedom of Information Act request, the motion indicates there is evidence “that politically motivated operatives in the Biden Administration and the National Archives and Records Administration began the crusade against President Trump in 2021.”

Furthermore, the court filing outlines how the ongoing case has disrupted a busy primary election for the GOP front-runner.
“The patent absurdity of the Office’s efforts is illustrated by the fact that, while working toward a historic landslide victory in the Iowa caucuses yesterday, President Trump was also preparing to bring to Your Honor’s attention today the record of misrepresentations and discovery violations that have marred this case from the outset and illustrate that the Office has disregarded fundamental fairness and its legal obligations in favor of partisan election interference,” the lawyers wrote.
In addition to evidence related to “temporary secure locations” at multiple Trump-owned properties, the motion also requests that Smith’s office release communication records “with prosecution team members regarding the underlying investigation by members, relatives, or associates of the Biden Administration.”
